Acceptance of these terms

These Terms of Service form an agreement between you (“you”, “the customer”) and the operator of Vistaria, the service published at vistaria.app. By creating an account, using the service, or paying for any plan, you confirm that you have read and accept these terms and the Privacy Policy.

If you do not agree with any part of them, please do not use the service. If you are signing up on behalf of a company, you confirm that you are authorized to accept these terms for it.

What the service does

Vistaria analyzes your website and, from that analysis, produces SEO reports, content plans, articles, daily topics and social-media content. Part of the service is free (the initial scan) and part requires a paid plan.

The services are modular: each has its own activation window and price. The complete and current list is published on the pricing page, and that page governs.

We may improve, change or remove features. If a change would materially reduce something you have already paid for, it does not apply to you until your paid period ends.

Your account

Your account is identified by an email address or a Telegram ID, and sign-in is passwordless via a one-time code. Keeping access to that mailbox or Telegram account secure is your responsibility, and activity performed through it is treated as yours.

• The service is not available to anyone under 18, or otherwise unable to enter into a contract.
• Each account must belong to a real person or business. Creating multiple accounts to work around free quotas or site limits is not permitted.
• If you lose access to your account, contact us through the channels listed on the contact page.

Prices and payment

• All prices are in US dollars. The price of a purchase is the one shown to you on the confirmation page, before you pay.
• Payments are processed by Stripe. Your card details are entered directly with Stripe, never reach our servers, and are never stored by us.
• Taxes such as VAT or GST are calculated by Stripe at checkout where they apply, and are shown before you confirm.
• Access is activated once the payment is confirmed. If you are charged but the service does not activate, contact support and we will fix it or refund you.
• We may change prices. A change never affects a period you have already paid for, and for an auto-renewing subscription we notify you before a new price applies to a renewal.

Subscription term, auto-renewal and cancellation

Paid plans are subscriptions. Unless you cancel, they renew automatically at the end of each term and your saved payment method is charged again.

• The term length and the renewal date are shown before you pay, and in your dashboard afterwards.
• You can cancel at any time from the billing portal in your dashboard, or by contacting support.
• Cancelling stops the next charge. It does not end the period you have already paid for — you keep access until it expires.
• If a renewal payment fails, we may retry it and, if it keeps failing, suspend the subscription.

Content already delivered to you stays yours after a subscription ends; only new generation and delivery stop.

Refunds and right of withdrawal

If a service you paid for is not delivered because of a fault on our side, you get a full refund. Request it through support or by email; we normally review within three business days and refund to the original payment method.

• You were charged but the service did not activate, or you were charged twice.
• An outage or technical failure on our side prevented you from using what you paid for and was not fixed within a reasonable time — refunded pro rata for the unused days.

Not refundable: content that has already been generated and delivered (reports, articles, content plans, topics, social content) is treated as consumed; and dissatisfaction with SEO results or Google rankings, which is covered by the “No guaranteed results” section below.

If you are a consumer in the EU, the EEA or the UK, you normally have 14 days to withdraw from a distance contract. Because this service delivers digital content immediately, by purchasing you ask us to begin at once and you acknowledge that the withdrawal right is lost for content already delivered. The unused remainder of your term is still refundable under the paragraph above.

Your use of the service must be lawful. Specifically, you agree to:

• Only register and analyze websites you own, or have the owner's permission to analyze.
• Not use the service to produce or publish content that is unlawful, deceptive, defamatory, or that infringes anyone's rights.
• Not use the output for spam, search-engine manipulation, or any black-hat SEO technique.
• Not reverse-engineer, mass-automate, scrape, or work around the technical limits and quotas of the service.
• Not resell or sublicense your access without a written agreement with us.

Much of what Vistaria produces is generated by language and image models. That means:

• Output can contain errors, inaccurate statements or unverified claims. Reviewing it before publication is your responsibility, and we are not liable for the consequences of publishing it unreviewed.
• Absolute uniqueness is not guaranteed; similar output may be generated for other customers.
• You are responsible for respecting third-party intellectual property in what you publish, and for any AI-disclosure rules that apply in your field or jurisdiction.

Intellectual property

• The platform, its code, design, brand and analysis methods belong to us.
• Content generated and delivered to you belongs to you, and you may use it commercially without restriction.
• So that we can run the service, you grant us a limited, non-exclusive licence to process and store your site's data and content and — only when you ask for it — publish to the accounts you have connected. It exists solely to provide the service and ends when your account is deleted.

The service connects to others that you optionally link, or that we use to do the work: Stripe, Telegram, Instagram and Meta, WordPress, Google Search Console, and AI model providers.

Your use of those services is governed by their own terms. Changes, limits or outages on their side can temporarily disable part of our functionality; that is outside our control and outside our liability.

We do not guarantee any Google ranking, traffic level, follower count or sales volume. SEO and content marketing depend on many things we do not control: search-engine algorithms, competitors, the quality of your execution, and your market.

Our output is advice and tooling — not legal, financial or medical advice. Final decisions, and responsibility for them, are yours.

Availability

We work to keep the service available but do not guarantee uninterrupted operation. Updates, planned maintenance, infrastructure failures or third-party outages can interrupt access. Where a prolonged outage affects a period you paid for, the refund section applies.

Limitation of liability

To the maximum extent the law allows, our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim arose.

We are not liable for indirect losses — including lost profit, lost rankings, data lost at a third-party service, or reputational harm. Nothing here limits rights that cannot be waived under the law that applies to you.

Suspension and termination

You may stop using the service at any time and ask for your account and data to be deleted. We may suspend or terminate an account for breach of the acceptable-use section, abuse of free quotas, attempts to harm the service or other customers, or where the law requires it.

If a suspension is not caused by your breach, the unused part of your paid period is refunded.

Changes to these terms

We may update these terms. Every version is published with its date, and after a material change you are asked to accept the new version at your next purchase. Earlier purchases remain governed by the version you accepted at the time.

Governing law and disputes

These terms are governed by the law of the operator's place of business, and disputes are subject to the courts competent there. This does not remove the mandatory consumer-protection rights of the country where you live.
